Court orders businessman, Findlay, to undergo another medical check before ruling on his seized passport

The Lusaka Magistrates Court has ordered Lusaka businessman, Harry Findlay, to obtain another medical report from the Ministry of Health before the court makes a ruling on his application to access his seized passport in order to travel abroad for medical attention.

In her ruling, Lusaka Magistrate, Sylvia Munyinya, said the medical report that the accused earlier submitted before court from Mainasoko Hospital does not have details on whether the country has no health facilities that can handle the accused’s illness.

Magistrate Munyinya further ruled that there should be a medical report from the Ministry of Health to give such details.

In this matter, Findlay is charged with two counts of holding more than one passport and being found with endorsements of forged immigration stamps.

In his application, Findlay through one of his lawyers Jonas Zimba had disclosed that his client has a severe heart condition which needed urgent medical attention outside the country.

“The ruling of the court previously when we made an application was to the effect that the court cannot order a release of an exhibit which is not before court, but now the passport is tendered and before the court. The passport was taken from the accused upon apprehension,” Zimba said.

The matter has been adjourned to June 2, 2023 for the court to make a ruling on whether Findlay can be given back his passport and travel abroad for his medical attention.
