DPP seeks electronic service in K101 million forfeiture case linked to ex-minister, Musukwa

The Director of Public Prosecutions (DPP) has asked the Economic and Financial Crimes Court to approve electronic service of court documents in a non-conviction forfeiture case involving assets worth more than K100 million, allegedly connected to former Mines Minister Richard Musukwa.

In an affidavit supporting the ex parte application for substituted service, State advocate, Vivane Nsingo, assigned to the DPP’s Asset Forfeiture Department, said the motion for forfeiture was initially filed on June 9, 2025.

While Musukwa himself received physical copies of the originating notice on July 11 at his home in Lusaka’s Forest 27 area, Nsingo informed the court that serving the remaining interested parties had proven difficult.

She cited the sheer volume of the documentation two large bundles as a logistical hurdle, arguing that email would be a faster and more efficient alternative.

Among those named as interested parties are Tyness Nalwimba of Twenty Four Seven Standby Security Ltd; Alice, Kennedy, and Godfrey Musukwa of Sazamwe Mining Services Ltd; and Charity Musukwa of Kumapili Hotel Ltd,all reportedly based in Chililabombwe.

According to Nsingo, using electronic mail would ensure timely communication and prevent unnecessary delays in the proceedings.

The assets at the centre of the case include residential properties, apartment blocks, a hotel, a business complex, and undeclared land located within a protected forest reserve. The total estimated cost of the properties stands at K101 million.

Supporting the forfeiture request, Drug Enforcement Commission (DEC) senior investigations officer Emmanuel Khondowe stated in a separate affidavit that Musukwa, between 2011 and 2022, amassed an extensive property portfolio. The properties are registered under his name, as well as under companies and individuals believed to be closely linked to him.
