Barach Loans drags Anna Mwitwa Legal Practitioners to court over K1.4 million loan dispute

BARACH Loans Limited has taken Anna Mwitwa Legal Practitioners to the Lusaka High Court, alleging that the law firm defaulted on a loan repayment agreement exceeding K1.4 million.

According to court documents, Barach Loans Limited—registered as a financial services provider—sued the defendant, a firm of legal practitioners trading as Anna Mwitwa Legal Practitioners and operating from Kabulonga.

The plaintiff claims the defendant obtained several loan facilities over a five-month period.

The amounts allegedly advanced include K110,000 in December 2024; K50,000 in January 2025; K168,000 and K200,000 in February 2025; and an additional K500,000 in May 2025.

After reconciliation and negotiations, the parties are said to have agreed that the total amount owed, inclusive of interest, stood at K1,455,000.

The statement of claim further states that on September 15, 2025, the managing partner of the defendant law firm executed a written undertaking committing to settle the debt by September 30, 2025.

“The defendant expressly undertook to settle the entire sum by the agreed date but failed to honour the undertaking,” the plaintiff stated in its pleadings.

Following the alleged default, the plaintiff’s advocates issued a demand letter dated October 8, 2025, calling for immediate settlement of the debt.

The letter reportedly went unanswered, despite multiple follow-up reminders.

Barach Loans Limited argues that the defendant’s failure to clear the outstanding amount constitutes a breach of the undertaking and has exposed the company to financial loss.

The lender is therefore asking the High Court to compel Anna Mwitwa Legal Practitioners to pay the full K1,455,000, together with interest and costs.
