St Mary’s School opposes reinstatement of pupil accused of bullying

St Mary’s Secondary School has urged the Lusaka High Court not to order the reinstatement of a Form Two pupil allegedly accused of bullying, arguing that she was neither expelled nor forced to transfer but moved to another school at her mother’s request.

In an affidavit opposing an application for leave to commence proceedings during the Michaelmas vacation, Deputy Headteacher Davies Mubanga said the transfer was granted following a request by the pupil’s mother after a disciplinary hearing that did not proceed to completion.

Mubanga said the hearing, held on July 30, 2026, was discontinued after school authorities allegedly discovered that the mother was recording the proceedings without their consent and had secretly added other people to listen online.

He said the mother was informed of the procedure for appealing to the headteacher in accordance with the school rules.

Mubanga further argued that the institution followed Ministry of Education regulations, which provide for expulsion in cases of bullying.

He maintained that the pupil was not expelled and that the school did not force her to leave, insisting that the transfer was processed at her mother’s request.

Mubanga also expressed concern over social media posts announcing that the school had been sued, arguing that the matter was still at the stage of seeking leave to commence proceedings.

He said the posts prompted some parents to identify the plaintiff as a bully towards their daughters at the school.

Mubanga stated that St Mary’s was a grant-aided institution in which the Government had an interest, although it operated under the name St Mary’s Secondary School rather than being registered under that name.

He urged the court to dismiss the reliefs sought by the plaintiffs.

The pupil is seeking, among other remedies, a declaration concerning the school’s actions and an order for her reinstatement.
