Couple sues Kafue General Hospital over newborn’s stillbirth due to alleged medical negligence

A couple, Mubanga Chileshe Chulu and her husband, Stephen Chulu, have filed a lawsuit against the State, accusing Kafue General Hospital of medical and professional negligence leading to the tragic stillbirth of their newborn.

Chileshe, who was in her 41st week of pregnancy, was admitted to Kafue General Hospital on July 31, 2023, in anticipation of the birth of their child.

However, due to alleged negligence by hospital staff, their baby was stillborn and unresponsive shortly after delivery.

The couple, represented by their legal counsel, outlined several instances of negligence in their statement of claim, including failure to adequately monitor the progress of labor, failure to observe vital signs indicating distress, and failure to conduct necessary physical examinations.

They also alleged that the hospital incorrectly attributed the cause of death to Hypoxic Ischemic Encephalopathy (HIE) without proper assessment.

They are seeking damages for medical and professional negligence, loss of their child, mental anguish, trauma, and physical pain endured during labor, as well as punitive and exemplary damages.

The Chulus also requested interest on all awarded sums.
