Patriots for Economic Progress (PeP) leader, Tembo, sued Syakalima in the Lusaka Magistrate Court contending that the said statement expressed hostility and segregation against the people of Luapula .

It was alleged that the Minister on October 12, 2023 in an audio that was circulated by means of a computer system, did utter and publish on various media platforms hate speech language towards the people of Luapula by saying, “they have a poverty of the mind” and that the said statement expresses hostility and segregation against the said people.

Tembo stated that Syakalima had no justified excuse to issue such a statement against a particular ethic group.

He submitted that Syakalima committed a criminal offence under Section 65 of the Cyber Security and Cyber Crimes Act No. 2 of 2021 of the laws of Zambia.
