Police arrest Mwamba, Nakacinda, charge both with alleged sedition, misconduct

The Edgar Lungu-led Patriotic Front (PF) Chairperson for Information and Publicity, Emmanuel Mwamba, has been arrested and detained for alleged seditious practices, Police say.
Mwamba, aged 52, of Plot 136A Chandwe Musonda road Villa Elizabeth committed an offence which was Contrary to Section 57(1) (b) as read with Section 60 (1) (a) (b) (d) (I) of the Penal Code Act Chapter 87 of the laws of Zambia.
Police Spokesperson, Rae Hamoonga, confirmed the arrest and detention of Mwamba at Emmasdale police station in a statement issued in Lusaka on Tuesday.
Hamoonga said the accused was alleged to have on November 4, 2023 at 07:37 hours at unknown place using a computer system knowingly and without lawful excuse did post or allow to be posted on a Facebook page under the name of Emmanuel Mwamba.
“A post which is likely to bring into hatred or contempt or to excite disaffection against the administration of justice in Zambia and to incite violence or any offence prejudicial to public order or in disturbance of the Public peace,” he said.
Hamoonga indicated that the suspect had been detained at Emmasdale police Station and would appear in court soon.
Meanwhile, Hamoonga said Police had also recorded a warn and caution statement from PF Secretary General Raphael Nakachinda for the offence of sedition.
He revealed that Nakacinda, aged 43, of plot number 1794 Kafue District committed the offence that was contrary to Section 57(1) (b) and Section 60(1) (e) of the Penal Code Act Chapter 87 of the Laws of Zambia.
“Brief facts of the matter are that the accused Raphael Nakachinda with intent to raise discontent or disaffection among the people of Zambia, did cause to be published seditious words in the News Diggers of October 27, 2023 on page five,” Hamoonga said.
He claimed that was an intention meant to incite citizens to revolt against government.
Hamoonga indicated that the utterances were alleged to have been made during a press briefing on October 26, 2023 in Lusaka District of the Republic of Zambia.
“The accused has been detained at Emmasdale Police station,” Hamoonga said.
In the same vain, Hamoonga said that party vice president Given Lubinda had been warned and cautioned for the offences of  failure to submit or surrender passport, diplomatic passport or document.
He said this was contrary to section 21 of the passport Act number 28 of 2016 and in the second count for holding more than one passport, Diplomatic passport or travel document contrary to section 22 of the passport Act number 28 of 2016.
“It’s alleged that in the first count was committed between March 1, 2023 and October 26, 2023 while the second count between March 1, 2023 and November 14, 2023 in Lusaka,” Hamoonga revealed.
He added that the accused had been detained in Police custody at Westwood Police Station.
