High Court grants injunction, Morgan Ng’ona remains PF Secretary General pending appeal

Morgan Ng’ona has survived a dramatic legal scare and remains Patriotic Front (PF) Secretary General after the High Court swiftly stepped in to block Matero Member of Parliament Miles Sampa from altering the party’s records at the Registrar of Societies pending appeal.

On Wednesday, the Court of Appeal threw out Ng’ona’s bid for an interim injunction, ruling that the application had been filed in the wrong court, stating such applications must first be made before the High Court unless exceptional circumstances exist.

The judges noted that Ng’ona had approached the appellate court without first seeking relief from the High Court.

But in a rapid legal turnaround, Ng’ona’s lawyers immediately moved to the High Court, where Judge Conceptor Chinyawa-Zulu granted an interim injunction restraining Sampa from interfering with Ng’ona’s role as PF Secretary General.

The court restrained Sampa from altering PF office bearer records at the Registrar of Societies until the appeal is determined by the Court of Appeal.

Judge Chinyawa-Zulu also set May 13, 2026 for inter-partes hearing of the matter.

According to an affidavit filed in support of the summons, Ng’ona argued that Sampa had already written to the Registrar of Societies seeking his removal from the party’s official records following the dismissal of his action for want of prosecution on March 3, 2026.

Ng’ona told the court that preserving the existing records was necessary to “maintain the status quo” while the appeal is pending.

On March 9, 2026, Ng’ona appealed the Lusaka High Court’s decision which dismissed his case challenging his expulsion and removal as SG of the party for want of prosecution.
