Factional PF president, Sampa, seeks court’s permission to serve Mwamba documents through newspaper advertisement

Patriotic Front (PF) faction president, Miles Sampa, has asked for permission of the Lusaka High Court, to serve court process on Emmanuel Mwamba by way of advertising in a daily newspaper in a matter the latter faces contempt of court.

Sampa’s advocates, Joseph Chirwa and company, complained that they had encountered difficulties to serve documents on PF faction Publicity and Information chairperson, Mwamba.

Legal assistant in the firm, Kangwa Chaile, submitted that he had failed to serve Mwamba with the court process because their registered address closed and there were no other known address.

“That the alleged contemnor ‘s whereabouts still remain unknown after all our inquiries yielded nothing and consequently, it has become reasonably impracticable to effect personal service. That owing to the alleged contemnor’s elusiveness, I did attempt to serve on the alleged contemnor through his mobile number.

“That this also did not yield any response from the alleged contemnor,” Chaile said.

He contended that it was proper case for the court to grant an order to serve court process by way of substituted service by advertising twice consecutively in the daily newspaper.

Sampa commenced contempt of court and committal proceedings against Mwamba alleging that he hosted a podcast which featured political commentators, Victor Kapungwe, and Chama Amerika, and made comments on the legality of the October 24, 2023 extraordinary general conference.

“That the podcast hosted by the the Petitioner was premised on establishing the illegality and legality of my election as party president of PF, a matter that is a subject of litigation before this court,” he said.

Sampa said the one minute, 57 seconds podcast video by Mwamba deliberately disrespected the sanctity of the on-going proceedings when he brought into discussion the matter coming up for trial before the court by questioning the legality.

“That the second Petitioner ought to respect the due process of the law and allow for the matter to be adjudicated upon fairly without presenting a narrative to the public that might cause conflict and embarrassment to the court,” he said.

This is in a matter in which Mutotwe Kafwaya, Mwamba, Geoffrey Bwalya Mwamba, Chishimba Kambwili, Greyford Monde, Chitalu Chilufya and Brian Mundubile have challenged the election of Sampa as party president.

The petitioners sued Sampa who allegedly convened an illegal gathering and Morgan Ng’ona, who he later appointed as Secretary-General of the Party.
