Police officer, businessman receive two year-jail terms for corrupt practices

A Zambia police officer has been sentenced to two years imprisonment with hard labour by Choma Subordinate Court for corruptly releasing two suspects, Vernon Ntunka and Crispin Ntuunka, from Police custody.

Anti-Corruption Commission (ACC) Head- Corporate Communication, Timothy Moono, said the Commission arrested Justine Kainga, a police officer, 45 of house number 40 Macha area, Choma.

Moono said Choma Subordinate Court charged Kainga with abuse of authority of office contrary to Section 21 (1) (a) and Corrupt practices contrary to Section 19(1) as read with section 41(a) of the Anti-Corruption Act No.3 of 2012.

He added that Justine Kainga had on an unspecified date but betweem March 1 and 31, 2020 in Choma, Southern Province, arrested Vernon Ntunka and Crispin Ntuunka, for matter that remained unreviewed.

“Kainga between 1st and 31st August, 2020 in Choma, being a public officer did corruptly solicit K6,000 and actually obtained K2,000 to enable the release of Vernon Ntunka and Crispin Ntuunka from police custody, a matter or transaction involving the Zambia Police Service, a public body,” Moono stated.

He stressed that for this cause, the guilty was imprisoned with hard labor in count 1 and 12 months imprisonment with hard labor in count 2.

Meanwhile, Moono revealed that the Economic and Financial Crimes Court had sentenced Lusaka businessman, Adolphus Mubanga, to two years imprisonment for being in possession of property suspected to be proceeds of crime amounting to K5 million.

He said in June, 2022, government Joint Investigations team arrested Mubanga, 59, of House number 11438, Makeni, Lusaka and charged him with three counts of being in Possession of Property Suspected to be Proceeds of Crime contrary to Section 71 (of the Forfeiture Proceeds of Crime Act No. 19 of 2010, of the Laws of Zambia.

“Particulars in count one (1) being that Adolphus Mubanga between 1st June 2021 and 30th August 2021 in Lusaka, did possess the sum of K4,050,000.00 property reasonably suspected of being proceeds of crime. In count two (2) Mr Mubanga between 1st July 2015 and 30th August in Lusaka, did possess the sum of K980,000.00, property reasonably suspected of being proceeds of crime.” Moono said.

In count three, he added, Mubanga between on August 1, 2015 and November 30, 2015 in Lusaka Province, possessed the sum of K525, 954.00 property reasonably suspected of being proceeds of crime.
