Failed Contract: Law Association of Zambia not entitled to any refund, Chaminuka Lodge tells court

The Law Association of Zambia (LAZ) is not entitled to any refund of over K100,000, on account that it cancelled the conference within 24 hours of its hosting, Chaminuka Lodge has submit to the High Court.

In this matter, LAZ sued Chaminuka Lodge in the Lusaka High court for failing to refund K117,045, being money paid for accommodation and hosting of a conference.

LAZ is also demanding interest on the said sum from date of payment.

The association claimed to have made a payment of K117,045, to the defendant through bank transfer for lodging of the delegates and hosting of the said workshop on July 29, 2022.

It stated that the delegates were scheduled to check in on August 4, 2022 but were notified by the lodge workers that they had been booked in the villa and not the known rooms of the Lodge.

Chaminuka Lodge in its defence filed Wednesday, admitted to LAZ having made full payment of the amount in question and the said Villas were the rooms that were reserved for the plaintiff at the time of booking.

“That the plaintiff did not specify the types of rooms it wanted reserved and that at the time of booking, the plaintiff was informed that the Villas were the rooms available for that period. That all information was given to the plaintiff at the point of booking,” it stated.

Chaminuka Lodge told the court that in accordance with its cancellation policy, individuals were only entitled to full refund if the cancellation is made within 14 days notice before the date of arrival.

It further stated that any cancellations made 7 days prior to the arrival, the lodge was not entitled to levy the full charge of the entire booking.

“The defendant wil prove at trial that the plaintiff made its cancellation within 24 hours of its arrival and as such is not entitled to any refund,” Chaminuka Lodge countered.

The lodge contended the claims by LAZ were misconceived and wrongly before court, thus urged the court to dismiss the matter with costs.
