The Ministry of Labour and Social Security has imposed a K40,000 administrative penalty on Nyimba Investments limited of Eastern Province for non-compliance with the new Minimum Wages for Bus and Truck Drivers.
The new Minimum Wages came into effect on April 10, 2025 contrary to paragraph 4 of Statutory Instrument No. 3 of 2025.
Ministry of Labour and Social Security Principal Public Relations Officer, Mwaka Ndawa, confirmed the development in a statement issued in Lusaka on Wednesday regarding the decision made by the Office of the Labour Commissioner.
Ndawa said the company had also been penalized for non-payment of gratuity to some of the workers after their contracts came to an end in 2024, contrary to Section 73 of the Employment Code Act (ECA) No. 3 of 2019.
She stated that to remedy the contraventions, the office of the Labour Commissioner has directed the company to pay the workers who are entitled to receive gratuities.
“This should be at the rate of 25% of the basic pay in accordance with section 73 of the ECA and pay the new Minimum Wages and subsistence allowances for Bus and Truck Drivers by May 30, 2025,” Ndawa said.
She announced that Nyimba Investments limited, had since paid the fine.

Similary, Alliance Generis Company has also been penalized for not issuing employees with written contracts and lack of employment policies.
Others are Zamwina Investment in Mwinilunga, Atlas Farming in Mkushi, and Chakwakwa Limited in Kabwe, for lack of written employment contracts and employment policies such as HIV/AIDS, Harassment policy, Health and Wellness policy and Performance management policy.
“The office of the Labour Commissioner in line with sections 133(1)(g) of the Employment Code Act, No. 3 of 2019, is mandated to publish the names of companies that contravene various sections of the Act,” Ndawa said.
She assured of government commitment to ensuring that employees rights were respected and employers engaged in social dialogue with their employees.
Ndawa said the Ministry would continue to carryout inspections and ensure compliance with the law, to protect the rights and welfare of workers.
