Road safety agency sues Magosha Enterprises over expired anti-virus software

The Road Transport and Safety Agency (RTSA) has sued Magosha Enterprises Limited in the Lusaka High Court, demanding a refund of K114,750 for supplying expired anti-virus software.

According to a statement of claim, RTSA awarded Magosha a tender between March 28 and 31, 2022, for the supply and installation of ESET Mail Security software for the agency’s Microsoft Exchange Server.

The contract, which was valid for 12 months, was fully paid for on April 1, 2022.

However, when RTSA’s ICT department installed the software on May 11, 2022, it discovered that the licence key had already expired, rendering the software inactive.

RTSA claimed it contacted the company on September 1, 2022, and while Magosha initially acknowledged the issue and pledged to resolve it, a replacement licence key provided on September 29 also failed to activate the software.

Two follow-up emails sent on October 5 reportedly went unanswered, prompting RTSA to take legal action.

The agency says the breach has left its systems vulnerable to cyber threats for over a year and caused significant inconvenience.

RTSA is now seeking a refund of the contract sum, damages, interest, and legal costs.
