Lusaka court orders cleaning firm to pay K2 million for breach of contract

The Lusaka High Court has found FM Cleaning Services Limited liable for breaching a Supply-Level Agreement with Nemchem International Limited and has ordered the company to pay K2 million in damages.

In a judgment delivered by High Court Judge Bonaventure Mbewe, the Court ruled that FM Cleaning Services failed to honour the terms of the contractual agreement, resulting in financial loss to Nemchem International.

The Court further ordered FM Cleaning Services to pay approximately K2 million in damages, plus interest and legal costs.

Judge Mbewe held that the evidence before the Court sufficiently demonstrated that FM Cleaning Services breached the supply-level contract, thereby warranting compensation for the losses suffered by Nemchem International.

The judgment concludes a commercial dispute arising from the contractual relationship between the two companies and reaffirms the principle that parties to commercial agreements must strictly adhere to their obligations.

FM Cleaning Services Limited is chaired and managed by Lawrence Makumbi, who serves as both Board Chairperson and Managing Director. Makumbi is also the President of the Cleaning Association of Zambia (CAZ).

Nemchem took Makumbi to court seeking damages for breach of the Supply-Level Agreement dated October 26, 2023, entered into by the two parties. The firm sought an order for the immediate payment of K676,356.71, the outstanding balance for products, services and equipment received by Makumbi.
