The Oasis Forum has maintained that Constitution Amendment Bill No. 7, which has been assented into law by President Hakainde Hichilema Dec 18, was unconstitutional.
President Hichilema assented to the Constitution (Amendment) Bill No. 7 following its passage by the National Assembly on December 15, 2025.
In a statement issued in Lusaka on Thursday, Forum Acting Chairperson Lungisani Zulu said the law was conceived and processed through procedures that violated constitutional requirements.
Zulu said the process disregarded binding Constitutional Court authority and failed to meet the standard of meaningful public participation.
“An unlawful process cannot yield a lawful statute, and no amount of political packaging or numerical advantage in Parliament can cure foundational illegality,” he said.
Zulu further stated that the expansion of Parliament without transparent delimitation, coupled with an increase in the number of Members of Parliament, entrenches control rather than accountability.
He said this development marked a retreat from constitutionalism and weakened Parliament’s role as a guardian of democracy.
“We therefore strongly urge citizens to remain vigilant and to pay close attention to how Government implements the law arising from Bill 7 — including sequencing, delimitation, subsidiary legislation, and the exercise of increased nomination powers,” Zulu said.
He added that abuses of power often occur not only during the passage of laws, but even more acutely in their operationalisation.
Zulu reaffirmed the Forum’s unwavering commitment to constitutionalism, the rule of law, and good governance — principles he said were essential to Zambia’s democratic future and the welfare of its citizens.
