Chief Justice urges newly sworn-in magistrates to uphold judicial independence

Chief Justice Mumba Malila has urged newly appointed Chief Resident Magistrates to safeguard judicial independence, resist corruption, and remain steadfast in professionalism.

Speaking during the swearing-in ceremony at the High Court on Thursday, Justice Malila administered the oath of office to Ms Janet Illunga, Ms Anastasia Lungu, and Ms Makalo Mwaanza.

He reminded the magistrates of their constitutional obligation to dispense justice impartially, without fear, favour, ill-will or influence, adding that no member of the judiciary leadership, including himself, had authority to direct how they decide cases.

“It is not the role of the Chief Justice, the Deputy Chief Justice, or any member of judiciary leadership to instruct you on your cases. You are entirely independent,” he said. “Any attempt to influence your decision-making is misconduct and must be addressed.”

Justice Malila also warned against the impact of social media and public opinion, stressing that misinformation should not sway their judicial conduct.

“Social media may claim the Chief Justice decides who you convict or acquit. That is entirely false. Your oath demands independent interpretation of the law,” he said.

On corruption, he cautioned the magistrates to reject any attempts at bribery or nepotism.

“If anyone tries to influence you with money, report it. If a friend or relative appears before you, recuse yourself. Integrity is key,” he advised.

Ms Lungu previously served as Master of the Supreme Court, while Ms Illunga held various roles including researcher and advocate at the Supreme Court, Director of Registrars, and District Registrar.

Justice Malila urged the trio to uphold the values of the judiciary and let the law and conscience guide their decisions.
