Woman who accused police officers of raping her committed to high court for murder trial

Meya Masumba Miti, the woman who recently accused police officers of raping her while in custody, has been committed to the High Court for trial on a charge of murder.

Miti, along with co-accused Florence Banda, stands accused of murdering her husband, Dr. Francisco Miti, a former Ministry of Agriculture official, following a reported break-in at their Lusaka home on August 23, 2024.

Dr. Miti sustained severe head injuries during the incident and later died at the University Teaching Hospital.

When the matter came up before Magistrate Keegan Litiya on Monday, the State presented a certificate of committal for summary trial in the High Court.

The charge, under Section 200 of the Penal Code, was formally read to the accused.

Prosecutors allege the two women acted together in committing the offence.

Meanwhile, Miti has filed an application for a writ of habeas corpus in the Lusaka High Court, claiming unlawful detention and sexual assault by police.

In her affidavit, Miti alleged that she was raped while handcuffed by one of two officers tasked with transferring her from Chilanga to Musamba Police Post.

She claimed the assault occurred in a bushy area near Chilanga Cement.

Miti further alleged she was tortured by her arresting officer and seven others upon her detention on September 13, 2024, and held incommunicado for more than a week due to her injuries.

She claimed to still bear visible scars on her arms and legs.

Her affidavit names the Lusaka Division Commissioner of Police and the Attorney General as respondents. Despite filing formal complaints in February, Miti alleged she remained in custody without being charged or appearing in court until the recent committal.

The matter is expected to proceed in the High Court.
