Zambezi East Member of Parliament, Brian Kambita, has asked the High Court to enter a judgment on admission against jailed former Lusaka Province Minister, Bowman Lusambo, in a matter concerning a failed house construction contract.
Kambita is demanding K650,000, which he claimed Lusambo owed him following the collapse of the agreement.
In an affidavit filed in response to Lusambo’s opposition, Kambita disputes the former minister’s assertion that the contract was frustrated. He insists it was Lusambo who breached the agreement.
“I dispute the contents of paragraph 5 of the affidavit in opposition, insofar as they relate to the defendant’s assertion that the contract was frustrated. I restate that the contract was breached by the defendant,” Kambita stated.
While not contesting most parts of Lusambo’s affidavit, Kambita acknowledged that K200,000 was sent to a third party, Brian Sivale, but maintained that Lusambo remained liable for the full amount.
He further argued that Lusambo had made a clear and unambiguous admission of owing K650,000, and urged the court to enter judgment accordingly.
Kambita also challenged Lusambo’s attempt to offer certificates of title as security, noting that they were not in Lusambo’s name and, therefore, could not be considered valid collateral.
“I dispute the contents of paragraph 4 of the affidavit in opposition and maintain that judgment on admission should be entered for the undisputed amount of K650,000,” Kambita submitted.
