A Lusaka-based company has asked the High Court of Zambia to enter judgment in default against former Health Minister, Chitalu Chilufya, for allegedly failing to enter appearance or file a defence in a matter involving more than K3 million arising from a disputed property transaction.
In its application for judgment in default of appearance and defence, Kramerville Enterprises Limited submitted that the defendant had not responded to a writ of summons or delivered a defence to the statement of claim.
The firm is seeking an order compelling Dr Chilufya to pay K3,190,000 with interest, together with costs to be taxed in default of agreement.
The application had not yet been signed or granted by Judge Elita P. Mwikisa at the time of filing.
According to a statement of claim filed on March 30, 2026, Kramerville Enterprises alleged that Dr Chilufya induced the company into purchasing a property in Avondale by representing that he owned it and was capable of passing good title.
The firm said it agreed to purchase Stand No. F/609/A/33 on Poplar Avenue for K3.5 million, paying the full amount in two instalments in April and May 2025.
It is alleged that only after receiving payment in full did Dr Chilufya disclose that the property was registered in another person’s name.
Kramerville Enterprises further claimed that subsequent attempts to conclude the transaction revealed the property had been mortgaged and could not be transferred without settling an additional K2.5 million. The mortgage, reportedly registered in 2022, was allegedly not disclosed prior to the sale.
The company stated that efforts to resolve the matter amicably failed. The dispute was later reported to police, prompting partial repayments totalling K310,000, which were acknowledged in January 2026.
Despite the repayments, the company said Dr Chilufya had neither completed the transaction nor refunded the outstanding balance. It is seeking K3.19 million, damages, interest and legal costs.
