The Lusaka High Court has struck out an application by Zambezi East Member of Parliament, Brian Kambita, seeking a judgment on admission against former Lusaka Province Minister, Bowman Lusambo, over an alleged K650,000 debt.
Judge Sharon Newa removed the matter from the active cause list on June 16, 2025, citing Kambita’s failure to prosecute the case. However, the court granted him liberty to restore the matter within 30 days, failure to which it will stand dismissed for want of prosecution.
“Upon hearing counsel, the application to enter judgment on admission is struck off the active cause list with liberty to restore within 30 days, failure to which it shall stand dismissed for want of prosecution. Today’s costs go to the defendant, which shall be taxed in default of agreement,” ruled Judge Newa.
Mr Kambita had asked the court to enter judgment against Mr Lusambo, alleging that he had failed to honour a contract involving the sale of a house, resulting in an outstanding balance of K650,000.
He argued that the debt was not in dispute and that the matter did not require a full trial.
However, in opposing the claim, Mr Lusambo contended that the contract had been frustrated and disputed the claim, particularly challenging the use of title deeds as collateral, arguing that the property in question was not registered in his name.
